Information clause

This information clause concerns the processing of personal data of candidates applying via the recruitment form and submitted application documents (CV, cover letter).

 

In accordance with Article 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR, we inform you that:


1. Personal Data Administrator

The administrator of your personal data is Asmet Sp. z o.o. located at ul. Kamienna 1, 89-650 Czersk.

3. Purpose and legal basis of processing

The administrator will process your personal data:

  1. for the purpose of conducting the recruitment process, based on the employer's authority resulting from Article 221 of the Labor Code and within the scope of data required by labor law regulations, in particular, name and surname, contact details, and other data necessary for the recruitment process for a given position. The legal basis for processing the aforementioned personal data is a legal obligation (Article 6(1)(c) GDPR),
  2. for the purpose of conducting the recruitment process, based on your consent to process your personal data, i.e., personal data other than those indicated in the above point, provided in the CV, form, cover letter, and other documents. The basis for processing is the aforementioned consent (Article 6(1)(a) GDPR),
  3. for the purpose of fulfilling the legitimate interest of the administrator to the extent necessary to assess professional qualifications and match you to the position, without making decisions in an automated manner. The basis for processing these data is our legitimate interest (Article 6(1)(f) GDPR),
  4. for the purpose of fulfilling the legitimate interest of the administrator in the event of a legal need to demonstrate facts, demonstrate the fulfillment of obligations (basis from Article 6(1)(f) GDPR),
  5. for the purpose of conducting future recruitment processes, based on your consent to process personal data provided in the CV, form, cover letter, and other documents. The basis for processing is this consent (Article 6(1)(a) GDPR).

 

4. Rights of data subjects

According to GDPR, you have the right to request access to your personal data and receive a copy, the right to request their rectification (correction), deletion, or restriction of processing, as well as the right to data portability. You have the right to object to the processing of data processed based on Article 6(1)(f) GDPR, as indicated above in point 3, at any time.

The above requests can be sent to the addresses indicated in point I. Additionally, according to GDPR, you have the right to lodge a complaint with the President of the Personal Data Protection Office.

 

5. Retention period

  1. in the scope indicated in points 3.1, 3.2, and 3.3, your data will be stored for the time necessary to conduct this recruitment,
  2. in the scope indicated in point 3.4, your data will be stored for the period of limitation of claims resulting from legal regulations, as well as for the time during which the regulations require us to store the data,
  3. in the scope indicated in point 3.5, your personal data will be stored for 12 months from the date of consent.

 

6. Data recipients

Your personal data may be transferred to authorized institutions specified by legal regulations and processing entities that provide services to the Data Administrator and to whom these data are entrusted (e.g., IT and email service providers, including Microsoft 365).

 

Data may be transferred outside the European Economic Area (e.g., to the USA) based on standard contractual clauses approved by the European Commission.

Data is transferred only to the extent necessary to carry out the recruitment process.

 

7. Voluntariness of providing personal data

In the scope of data required by labor law regulations, providing personal data is a condition for participating in the recruitment process. In other respects, providing personal data is voluntary.

 

8. Profiling

We inform you that we do not make decisions in an automated manner, including in the form of profiling.

 

9. Consent and information on the possibility of withdrawing consent

You have the right to withdraw your consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of processing based on your consent before its withdrawal. 

 

A statement of withdrawal of consent can be sent to the email address indicated in point 2 or in writing to the address of the Administrator's headquarters.
